Nestle Fails to Trademark Kit-Kat

Nestle failed its multiple attempts to Trademark its four-finger, chocolate-covered wafer, Kit-Kat. It began with Cadbury first scuttling it in 2010 and the rejection by UK Trade Marks Registry in 2013 and ended today being dismissed in the final hearing in UK High Court.
Before appeal it was rejected by European Court of Justice as the product is ‘not distinctive’.
